Common Types of Divorce Cases We Handle
Choosing the right path to divorce can be daunting, but you don’t have to do it alone. Our attorneys evaluate your circumstances, explain the available divorce processes, and prepare you for each step. A contested divorce may involve disagreements about property, debts, support, custody, or another material term, while an uncontested or collaborative path may be available when spouses can reach an agreement.
Below are some common types of divorces we handle:
“I appreciated Kurt Smith and the team’s guidance during a difficult and emotional divorce.”

Who Is Eligible to File for Divorce?
To file for divorce in Nevada, at least one spouse generally must have resided in the state for at least six weeks before filing, subject to statutory exceptions. A divorce attorney can review the facts of your situation and explain which filing requirements apply.
Nevada law provides several possible filing bases, which can include the plaintiff’s residence, the defendant’s residence or presence, the parties’ last cohabitation, or where the cause accrued. Divorce filings in Clark County proceed through the Family Division of the Eighth Judicial District Court, but the proper venue depends on the circumstances of the case.
Is Nevada a No-Fault Divorce State?
Yes. Nevada is a no-fault divorce state, meaning you aren’t required to provide proof of wrongdoing by either party, such as abuse or infidelity, to seek a divorce based on incompatibility. This allows one party to file for divorce even if their spouse doesn’t want one.
“Grounds” refer to legally acceptable reasons for divorce.
These may include:
- Incompatibility. You and your spouse are incompatible and can’t get along.
- Separation. Both spouses lived separately for one year without cohabitation.
- Insanity. Insanity existed for two years before filing for divorce.
