What Is a Prenuptial Agreement?

A prenuptial or premarital agreement is a written contract signed by both parties before marriage and effective upon marriage under NRS 123A.060. It defines each party’s financial rights and obligations in the event of divorce or separation. Because Nevada is a community property state, property acquired during marriage is generally presumed to belong equally to both spouses under NRS 123.220. Types of Prenuptial Agreements

Nevada law allows couples to tailor a prenuptial agreement to their specific circumstances. The three most common agreement types address property division, financial management during the marriage, and inheritance rights after death.

A property agreement covers how assets will be divided in a divorce. Nevada law presumes an equal 50/50 division of community property acquired during marriage under NRS 123.220 and NRS 125.150. A property agreement replaces that default with a custom framework: one that specifies which pre-marital assets remain separate, how appreciation of those assets is treated, and how jointly acquired property is divided. Business owners can use this type of agreement to prevent a company’s value, including growth in that value during the marriage, from being treated as divisible community property.

Lifestyle Agreements

A lifestyle agreement outlines how a couple will manage finances and shared expenses during the marriage. Nevada courts won’t enforce personal or subjective rules, but they do uphold clear financial obligations, such as which party pays the mortgage, how joint accounts are managed, or how household expenses are allocated. A lifestyle agreement is most effective when it focuses on measurable financial terms rather than conduct or personal behavior.

Estate Agreements

An estate agreement defines each party’s rights to property and assets after death. Under NRS 123A.050, a prenup can require one or both spouses to maintain estate planning instruments, including wills, trusts, or other arrangements, that protect agreed-upon beneficiaries.
