Does Nevada Honor Same-Sex Marriage?

Yes. Same-sex marriage became legal in Nevada on October 9, 2014, following a ruling by the U.S. Court of Appeals for the Ninth Circuit in Sevcik v. Sandoval. In November 2020, Nevada went further, becoming the first U.S. state to explicitly enshrine the right to marry regardless of gender in its constitution, with voters approving the change 62 to 38 percent. Because many same-sex couples shared finances and built lives together for years before marriage equality, standard divorce proceedings often fail to capture that full history. A Guide to Same-Sex Divorce in Clark County

Nevada applies the same divorce statutes and community property rules to same-sex marriages as to opposite-sex marriages. The procedural requirements and property rules below apply to any divorce filed in Clark County Family Court.

Residency Requirement

At least one spouse must have lived in Nevada for a minimum of six weeks before filing for divorce.

Filing Fee

Clark County charges a base filing fee of $299 for divorce, with the total potentially reaching $364 depending on the petition type. Verify the current fee with the Clark County clerk before you file.

Property Division

Nevada is a community property state, meaning marital assets are subject to equal division. Assets acquired during the marriage are generally treated as community property under NRS 123.220, while assets owned before the marriage date are classified as separate property. Grounds for Divorce

Nevada is a no-fault divorce state, so you don’t have to prove wrongdoing to obtain a divorce. Incompatibility, meaning an “irretrievable breakdown” of the marriage, is the ground cited in roughly 95 percent of Nevada divorces.

Domestic Partnership Dissolution in Nevada

Nevada began recognizing domestic partnerships under NRS Chapter 122A in 2009, five years before statewide marriage equality. Couples who registered a domestic partnership before later marrying may face dual-dissolution requirements: a formal divorce for the marriage and a separate dissolution process for the domestic partnership if it was never automatically converted.

The path forward depends on how long the partnership was registered and whether any issues remain unresolved:

Partnerships of Five Years or Less with no contested child or property issues may qualify to file a Termination of Partnership directly with the Nevada Secretary of State, a faster and less costly option than full court proceedings.
Partnerships Longer Than Five Years, or those involving disputed assets or children, must go through full family court divorce proceedings, following the same timeline and requirements as a standard Nevada divorce.
Out-of-State Marriages are recognized for divorce purposes in Nevada, provided at least one spouse meets the six-week residency requirement before filing at Clark County Family Court.
