How Family Law Mediation Works in Clark County

Mediation is a form of alternative dispute resolution where a neutral third party helps both sides reach a voluntary agreement. In Clark County, the process looks different depending on what’s being disputed.

Custody Matters & the Clark County Family Mediation Center

Under EDCR 5.303 and NRS 3.475, all parties to contested custody proceedings must complete mediation before the Eighth Judicial District Court will resolve those issues. The Clark County Family Mediation Center handles these cases. The mediator’s report to the court is limited to whether the dispute was resolved. Nothing substantively said during sessions is disclosed or can be used as evidence if the case later proceeds to litigation. Nevada law protects the confidentiality of mediation communications.

Exceptions to mandatory mediation exist for documented domestic violence or child abuse, or when one party resides outside Nevada. If your situation involves any of these, our attorneys can help you understand how your case proceeds.

Financial Issues & Private Mediation

The Family Mediation Center handles custody and visitation only. Property division, spousal support, child support, and other financial matters are addressed through private mediation. These sessions can run parallel to or follow custody mediation, letting families resolve all outstanding issues without multiple contested court proceedings.

When direct communication between parties is difficult, caucus mediation keeps both sides in separate rooms, with the mediator moving between them. This format is widely used in Clark County and can make the process workable even in high-conflict situations.

When Agreement Is Reached

A mediated agreement incorporated into a court order by the Eighth Judicial District Court carries the same enforcement weight as any other court order. Setting it aside generally requires showing fraud, duress, mistake, or a significant change in circumstances. Getting the terms right before you sign matters enormously, which is why having an attorney review the agreement before it becomes an order is critical.

What Mediation Can Cover

Post-divorce changes to a parenting plan or child support obligation can go through mediation rather than returning to contested litigation, which is often faster and less disruptive for families.

Even when mandatory mediation through the Family Mediation Center applies only to custody, private mediation can address all remaining financial and property issues in the same or parallel sessions.

When Mediation May Not Be Appropriate

Mediation generally isn’t the right fit when there is a history of domestic violence or a serious power imbalance between the parties. It’s also typically not appropriate when one party is hiding assets or acting in bad faith, or when the financial issues are complex enough to require formal discovery and expert analysis.
